Swap meet

Raising the minimum age on Kalshi to 21 would be tidy and mostly beside the point, because the product is a sportsbook with a federal licence and its youngest customers are its smallest problem.

Thirty-one cents of every $10 traded on Kalshi this year came from someone old enough to vote and too young to enter a Nevada sportsbook. That is the 3.14% that a Kalshi spokesperson gave CNN for the share of trading volume from users aged 18 to 21.1CNN via KEYTYoung adults under 21 traded $5 billion on Kalshi this year amid prediction market frenzy (CNN, syndicated)28 Aug 2026 It is a small number attached to a large grievance.

The grievance has a basis. CNN estimated that Kalshi users in that age group traded about $5.4bn in 2026 up to 28 August, of which roughly $3.9bn was in sports and parlays.1CNN via KEYTYoung adults under 21 traded $5 billion on Kalshi this year amid prediction market frenzy (CNN, syndicated)28 Aug 2026 2FortuneKalshi users under 21 traded $3.9 billion on sports prediction markets31 Aug 2026 Kalshi’s total volume was above $173bn on Paradigm’s figures, with about 80% from sports and parlays.1CNN via KEYTYoung adults under 21 traded $5 billion on Kalshi this year amid prediction market frenzy (CNN, syndicated)28 Aug 2026 Most states set the age for sports betting at 21. Kalshi allows 18, because it is a federally regulated financial exchange rather than a casino.2FortuneKalshi users under 21 traded $3.9 billion on sports prediction markets31 Aug 2026

Whether this is trading or gambling is the question everyone asks, and it is the less useful one. A prediction market does have a respectable economic function: prices that aggregate information about elections or inflation are worth having. But a venue where four-fifths of volume is sport is an exchange in the sense that a betting shop with a stock ticker is one.1CNN via KEYTYoung adults under 21 traded $5 billion on Kalshi this year amid prediction market frenzy (CNN, syndicated)28 Aug 2026 Kalshi told Connecticut legislators, in testimony opposing a bill to raise the age, that it “does not set odds, does not act as a counterparty, and does not profit from customer losses”.2FortuneKalshi users under 21 traded $3.9 billion on sports prediction markets31 Aug 2026 That is true of a betting exchange, too, and nobody confuses Betfair with the London Stock Exchange.

We think this is gambling with a better legal department. Still, we are unconvinced that the age line is where the argument should be fought. The figure that has caused alarm is a 3% share. The other 97% of volume, much of it sport, arrives from adults who are free to lose it. The 18-to-21 cohort is a good place to find a sympathetic victim and a poor place to find the business model. Les Bernal of Stop Predatory Gambling complains that the industry creates a “video game type experience” for the young.2FortuneKalshi users under 21 traded $3.9 billion on sports prediction markets31 Aug 2026 So it does for everyone else.

There is a respectable case on the other side. At 18 an American can sign a contract, join the army and open a brokerage account. A rule that lets her buy a stock fund but not a bet on a football match is hard to defend on grounds of consistency. The American Gaming Association, hardly a neutral party, calls the platforms a “backdoor route to sports betting”.3Public Gaming InternationalKalshi's 18 to 21 year old users trade $5.4B as betting age fight grows28 Aug 2026 Its irritation is partly commercial: sportsbooks it represents must turn away freshmen whom Kalshi may serve.1CNN via KEYTYoung adults under 21 traded $5 billion on Kalshi this year amid prediction market frenzy (CNN, syndicated)28 Aug 2026 Both positions are partly about market access, and neither is really about 19-year-olds.

The real fight is over who regulates the product at all. On 9 October the Commodity Futures Trading Commission proposed a rule that would define event contracts, with sports contracts named as an example, as swaps. Its chairman, Michael Selig, said they are “commodity derivatives squarely within the CFTC’s regulatory remit”.4Commodity Futures Trading CommissionCFTC Seeks Public Comment on Notice of Proposed Rulemaking Concerning the Inclusion of Certain Event Contracts in the Definition of Swap9 Oct 2026 The release says nothing about age. CNN reported that the commission had rejected calls from the NCAA and the major leagues for a minimum of 21 and was finalising rules that keep 18.1CNN via KEYTYoung adults under 21 traded $5 billion on Kalshi this year amid prediction market frenzy (CNN, syndicated)28 Aug 2026 Against it stand 44 state attorneys general, who argue that the federal rules intrude on states’ power over sports gambling, and a ruling from the Ninth US Circuit Court of Appeals that let Nevada apply its gaming law to Kalshi’s sports contracts.1CNN via KEYTYoung adults under 21 traded $5 billion on Kalshi this year amid prediction market frenzy (CNN, syndicated)28 Aug 2026 2FortuneKalshi users under 21 traded $3.9 billion on sports prediction markets31 Aug 2026 New York is suing to shut the platform down.2FortuneKalshi users under 21 traded $3.9 billion on sports prediction markets31 Aug 2026

This is where the matter will be settled, and we suspect only the Supreme Court can do it. If swaps are the right label, Washington sets the age and the protections. If they are not, states do, and the age will be 21 nearly everywhere.

Either outcome would be tidier than the present arrangement. Neither would change what the young are betting on, which is the same football game as their elders.
